Terms of Service

These Terms of Service ("Terms") govern your use of the Rhythmic AI DJ web application (the "Service") operated by Rhythmic ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have your parent or guardian's permission. By using the Service, you represent that you meet these requirements.

2. Account Registration

• You may create an account using email/password, Google sign-in, or Spotify sign-in.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account.
• You must provide accurate and complete information when creating your account.

3. Spotify Integration

• A Spotify Premium account is required for music playback. Rhythmic does not provide music streaming itself.
• All music is streamed directly from Spotify through their official Web Playback SDK.
• We do not download, copy, redistribute, remix, or modify any audio content.
• Your use of Spotify through this Service is subject to Spotify's Terms of Use.
• We do not guarantee uninterrupted access to Spotify's services. If Spotify's API becomes unavailable, the Service may be temporarily limited.
• You may disconnect your Spotify account at any time from your Spotify account settings.

4. Google Sign-In

• If you authenticate via Google, you grant us access to your basic profile information (name, email, profile picture) only.
• Your use of Google sign-in is subject to Google's Terms of Service.
• We comply with the Google API Services User Data Policy, including the Limited Use requirements.

5. Acceptable Use

You agree not to:

• Use the Service to circumvent Spotify's usage restrictions or terms
• Attempt to download, record, or rip any audio content
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools (bots, scrapers) to access the Service
• Interfere with the Service's infrastructure or other users' access
• Use the Service for any illegal purpose
• Share your account with others or create multiple accounts

6. AI-Generated Recommendations

• The AI DJ feature provides automated music recommendations and transitions. These are suggestions, not endorsements.
• We do not guarantee the accuracy, quality, or appropriateness of AI-generated recommendations.
• AI recommendations are generated using track metadata only. No personal information is sent to AI services.

7. Intellectual Property

• The Service, including its design, code, and branding, is owned by Rhythmic and protected by copyright and intellectual property laws.
• All music content is owned by respective rights holders and streamed via Spotify under their licenses.
• Saved mixes are arrangements of Spotify tracks and do not grant you any rights to the underlying music.

8. Service Availability

• We provide the Service on an "as is" and "as available" basis.
• We do not guarantee that the Service will be uninterrupted, secure, or error-free.
• We may modify, suspend, or discontinue the Service at any time without notice.
• We are not responsible for interruptions caused by Spotify, Google, or any other third-party service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHYTHMIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to your account
• Any interruption or cessation of the Service
• Any third-party services (including Spotify and Google)

10. Indemnification

You agree to indemnify and hold harmless Rhythmic from any claims, damages, losses, or expenses (including attorney's fees) arising out of your use of the Service or violation of these Terms.

11. Termination

• You may terminate your account at any time by contacting us or using the account deletion feature.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
